Unified Return and Claim Framework

This document establishes the unified framework governing inspection, acceptance, claims, and returns for all biomass products supplied by the Company.

This policy shall be read in conjunction with the Terms and Conditions and applicable agreements.

  1. Policy Position and Governing Principle

1.1 Policy Position

The Company operates on a strict:

  • No-return basis

No physical return of goods shall be accepted under any circumstances.

1.2 Governing Principle

  • Biomass products are industrial fuels
  • Product integrity depends on storage and handling
  • Supply is governed through specification tolerance and claim-based evaluation
  1. Nature of Product

Biomass pellets and briquettes:

  • Are derived from natural feedstock
  • Exhibit inherent variability
  • Are sensitive to moisture and environmental exposure

Accordingly, strict control over claims and returns is required.

  1. Inspection and Acceptance

3.1 Buyer Obligation

Buyer shall:

  • Inspect goods immediately upon delivery
  • Verify quantity, condition, and documentation

3.2 Claim Window

  • Claims must be raised within forty-eight (48) hours of delivery

3.3 Deemed Acceptance

Failure to notify within 48 hours shall constitute:

  • Final
  • Unconditional acceptance
  1. Claim Eligibility Framework

Claims (without return of goods) shall be considered only in the following cases:

4.1 Transit Damage

Material damage occurring during transportation.

4.2 Incorrect Supply

Goods delivered do not match confirmed order.

4.3 Specification Deviation

Substantial deviation from agreed specifications, where such specifications are:

  • Expressly agreed in writing
  • Documented in contract or CoA
  1. Claim Submission Requirements

Claims must include:

  • Photographic evidence
  • Video evidence (where applicable)
  • Delivery documents (invoice, LR, etc.)
  • Description of discrepancy
  1. Specification and Tolerance Framework

6.1 Tolerance Principle

Biomass products are subject to variability.

Defined tolerance ranges apply to:

  • Moisture
  • Ash content
  • Calorific value
  • Fines

6.2 Effect of Tolerance

Variations within agreed tolerance:

  • Shall be deemed acceptable
  • Shall not constitute defect
  • Shall not give rise to claim
  1. Claim Exclusions

No claims shall be entertained where:

7.1 Storage Conditions

  • Improper storage
  • Exposure to moisture
  • Lack of covered storage

7.2 Handling

  • Damage during unloading or handling
  • Contamination

7.3 Environmental Exposure

  • Degradation due to weather

7.4 Partial Consumption

  • Goods used, mixed, or processed
  1. Inspection and Verification Rights

The Company reserves the right to:

  • Inspect goods at site
  • Request samples
  • Appoint independent third-party inspector
  1. Remedies

Where a claim is accepted, the Company may, at its sole discretion:

  • Replace goods; or
  • Issue credit note; or
  • Provide partial refund

No obligation exists to accept return of goods.

  1. No Return Condition

Under no circumstances shall the Company:

  • Accept return of goods
  • Take back delivered material
  • Reverse supply
  1. Limitation of Liability

The Company’s liability shall be:

  • Limited to invoice value of affected goods

The Company shall not be liable for:

  • Production loss
  • Business interruption
  • Indirect or consequential damages
  1. Channel Alignment

12.1 E-commerce

  • Listings must clearly state industrial nature and restricted claims

12.2 Dealer Network

  • Dealer responsible for downstream handling
  • Claims due to storage or handling shall not be passed to Company

This policy is designed to:

  • Prevent misuse of return mechanisms
  • Maintain product integrity
  • Reflect industrial supply practices
  • Ensure commercial discipline
